TrustMate (Pty) Ltd - Republic of South Africa
1. Acceptance
By registering for or using TrustMate, including its website, applications and services, you agree to these Terms and Conditions.
2. Services
TrustMate provides a platform connecting vehicle owners and drivers and may offer verification, ratings, TrustScore calculations, telematics services and related products. TrustMate is not a party to agreements entered into between drivers and vehicle owners and does not guarantee employment, income, vehicle availability or driver performance.
3. Eligibility
Users must: be at least 18 years old; provide accurate information; maintain the security of their account; and comply with applicable laws.
4. Information and Verification
Users authorise TrustMate to collect, verify and process information including: identity documents; driver's licences; PDP documents; contact details; vehicle information; ratings and reviews; incident reports; payment history; and telematics and behavioural information where applicable.
5. TrustScore
TrustMate may calculate and update TrustScores using information including payment behaviour, ratings and reviews, vehicle care, safety records, driving behaviour, verification status, and incident history. TrustMate may modify TrustScore methodologies from time to time.
6. Telematics and Tracking
Where users provide consent, TrustMate may collect: GPS location data; speeding events; harsh braking; rapid acceleration; crash events; and mileage and trip information. Such information may be used for safety analysis, TrustScore calculations, product development, insurance and risk assessment products, and fraud prevention.
7. Data Sharing
Subject to applicable law and user consent, TrustMate may share information with: vehicle owners and drivers; verification providers; insurance companies; fleet operators; financial institutions; service providers; and regulatory authorities. TrustMate may use anonymized and aggregated information for analytics, research and commercial purposes.
8. User Rights
Users may: access their information; request corrections; withdraw optional consent; and request deletion where legally permissible.
9. Prohibited Conduct
Users may not: provide false information; impersonate another person; manipulate ratings; upload unlawful content; or use TrustMate for fraudulent activities.
10. Suspension and Termination
TrustMate may suspend or terminate accounts for: fraud; vehicle theft; false information; abuse of the platform; or criminal conduct.
11. Limitation of Liability
TrustMate provides the platform on an "as is" basis and does not guarantee the conduct or performance of any user.
12. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
TrustMate (Pty) Ltd - Protection of Personal Information Act, 2013
1. Introduction
TrustMate (Pty) Ltd ("TrustMate", "we", "us", or "our") respects your privacy and is committed to protecting your personal information in accordance with the Protection of Personal Information Act, 2013 ("POPIA"), the Electronic Communications and Transactions Act, 2002, and all other applicable laws of the Republic of South Africa. By creating an account or using TrustMate's website, applications, and related services, you acknowledge that you have read and understood this Privacy Policy and consent to the collection and processing of your information in accordance with this Policy.
2. Information We Collect
Personal Information: Full names, identity number or passport number, date of birth, gender, email address, mobile number, physical address, emergency contact details, profile photographs.
Verification Information: Identity documents, driver's licence, Professional Driving Permit (PDP), criminal background checks, vehicle ownership documents, banking and payment information, and supporting documents.
Platform Information: Applications, vehicle listings, ratings and reviews, complaints, incident reports, TrustScores, safety scores, payment performance records.
Technical Information: Device identifiers, browser information, IP addresses, cookies, operating system information, login records.
Location and Telematics (with consent): GPS location, speeding events, harsh braking, rapid acceleration, cornering behaviour, mileage, trip information, crash detection, and driver behaviour information.
3. Purpose of Processing
User verification; identity and fraud prevention; matching vehicle owners and drivers; calculating TrustScores and safety scores; facilitating contracts and transactions; improving products and services; investigating disputes and incidents; compliance with legal obligations; analytics and research; development of future products; risk assessment and behavioural analysis; fleet management services; and insurance-related products and services.
4. Sharing of Information
Subject to applicable laws and user consent, TrustMate may share information with: vehicle owners and drivers; verification providers; fleet operators; insurance companies; financial institutions; technology providers; cloud hosting providers; analytics providers; regulatory authorities; law enforcement authorities; and other authorised business partners. TrustMate may create and use anonymized, aggregated, statistical and de-identified information for research, analytics, product development and lawful commercial purposes. TrustMate does not sell personal information in violation of applicable laws.
5. Consent to Location Tracking and Telematics
Where users activate TrustMate's mobile application or related services, users expressly consent to the collection and processing of GPS location information, speeding events, harsh braking events, rapid acceleration events, cornering behaviour, mileage and trip information, crash detection information, and other driving and behavioural information reasonably necessary for TrustMate's services.
6. Data Retention
TrustMate may retain personal information for as long as reasonably necessary to provide services, resolve disputes, prevent fraud, enforce agreements, comply with legal obligations, and improve products and services.
7. Security
TrustMate implements reasonable technical and organisational measures to protect personal information against loss, unauthorised access, misuse, disclosure or destruction.
8. User Rights
Users may: request access to their personal information; request correction of inaccurate information; request deletion where legally permissible; withdraw optional consent; object to certain processing activities; and lodge complaints with the Information Regulator of South Africa.
9. Cookies and Analytics
TrustMate may use cookies and similar technologies to improve user experience, monitor platform performance, analyse usage trends, enhance security, and deliver personalised services.
10. International Transfers
TrustMate may store or process information using service providers located outside South Africa, provided adequate safeguards are implemented and applicable laws are complied with.
11. Policy Updates
TrustMate reserves the right to amend this Policy from time to time. Updated versions will be published on the platform and may require renewed consent.
12. User Consent
By creating an account or using TrustMate's services, I acknowledge and agree that: TrustMate may collect, process, analyse and retain my information; TrustMate may verify information submitted by me; TrustMate may calculate TrustScores, safety scores and behavioural insights; TrustMate may use anonymized, aggregated and de-identified information for research, analytics and lawful commercial purposes; optional location tracking and telematics will only be collected where I provide the necessary permissions and consent; I may withdraw optional consent where permitted by law; and I have read and understood this Privacy Policy.
